the following property sales contract is concluded:

§ 1 Object for sale

The subject of the contract is the following object:


The contract property is supposed to be sold together with the entire home furnishings (furniture, household items, electrical appliances, etc.).

See attached inventory list.

The object of the contract is to be sold, whereby the highest possible price is to be achieved:

§ 2 Exclusiv agency/ Duration

The agency has the exclusive selling rights for the property. This agreement shall remain in effect for a period of 12 months from the date it is signed by client.

During this period the client is not entitled to mandate other agencies to sell the property.

The contract shall be extended by three months in each case if it is not terminated in writing with four weeks notice to the end of the respective term.

§ 3 Service

The agency will perform the sale in an appropriate manner. Furthermore the agency is responsible for suitable advertising measures.

§ 4 Documents and information

(1) The client declares, that he is the sole owner of the property. The client also declares that the property is free of mortgages, liens, taxes, fees, liabilities and other charges.

(2) The client will provide all documents and information about the property which are required for the implementation of the order.

§ 5 Commission

(1) The commission is due when the sales contract is concluded. This agreement is also valid if the property has been purchased by a life partner, family member or if the negotiations have been conducted on behalf of a company, co-founder or someone who has granted his privileges.

§ 6 Reimbursement of expenses

The agency takes over all expenses for advertising, insertions, exposés, postage, photocopies, etc.

This also applies if the agency is not able to sell the property during the term of this contract.

§ 7 Side agreements, additions and changes, Severability clause

The provisions of this Agreement shall apply mutatis mutandis to a partial ownership, a residential heritable building right and a partial heritable building right, unless otherwise provided by the content and purpose of individual provisions.

Tacit, oral or written subsidiary agreements were not made. Changes and additions to this contract must be in writing / text form. This also applies to a repeal of this clause.

Should individual provisions of this contract be ineffective, this shall not affect the validity of the remaining provisions.

§ 8 Place of jurisdication

Jurisdiction for disputes arising from this contract is the headquarters of ECLESS S.B.T. İNŞAAT LTD. ŞTİ.

§ 9 Final Provisions

Should individual provisions of this agreement be or become ineffective, the validity of the remaining provisions of this agreement remains unaffected. The parties undertake to agree in this case a legally effective, the economic purpose of the ineffective clause as close as possible coming regulation. The same applies to the case of a gap in need of regulation. Verbal collateral agreements do not exist.

Changes to this contract must be made in writing. This also applies to the agreement on the modification of the written form.

With my signature, I fully acknowledge this contract and its attachments, the aforementioned conditions and agreements. I confirm the accuracy of my information in this contract and in the data entry form.
